NDAA: The Most Important Lawsuit in American History that No One is Talking About

Despite a mainstream media blackout on the topic, the alternative media is abuzz with this week’s hearing on the constitutionality of the clearly unconstitutional NDAA.  In case you don’t remember, section 1021 of the NDAA, which Obama signed into law on December 31 of last year, allows the government to lock up U.S. citizens indefinitely without a trial.  At the time of signing, Obama penned a pathetic letter to many of his outraged supporters where he basically said he signed it but he won’t use it.  Thanks pal!

In any event, the Administration is showing its true colors by appealing an injunction that judge Katherine Forrest issued against it in May.  The injunction was in response to the lawsuit filed by Pulitzer Prize winning journalist Chris Hedges and others.  While the NDAA clearly vaporizes the 5th and 6th Amendments of the Constitution, I believe the real target is the 1st Amendment.  By having a law on the books that allows the government to arbitrarily lock anyone up and throw away the key, the government is actually trying to instill enough fear in people that they self-censor speech and become too afraid to criticize the criminal elite political and economic oligarchy.

Tangerine Bolen is one the lead plaintiffs in the suit against the government and she penned a powerful piece for the UK’s Guardian.  Here are some key quotes:

I am one of the lead plaintiffs in the civil lawsuit against the National Defense Authorization Act, which gives the president the power to hold any US citizen anywhere for as long as he wants, without charge or trial.

In a May hearing, Judge Katherine Forrest issued an injunction against it; this week, in a final hearing in New York City, US government lawyers asserted even more extreme powers – the right to disregard entirely the judge and the law. On Monday 6 August, Obama’s lawyers filed an appeal to the injunction – a profoundly important development that, as of this writing, has been scarcely reported.

Judge Forrest had ruled for a temporary injunction against an unconstitutional provision in this law, after government attorneys refused to provide assurances to the court that plaintiffs and others would not be indefinitely detained for engaging in first amendment activities. At that time, twice the government has refused to define what it means to be an “associated force”, and it claimed the right to refrain from offering any clear definition of this term, or clear boundaries of power under this law.

This past week’s hearing was even more terrifying. Government attorneys again, in this hearing, presented no evidence to support their position and brought forth no witnesses. Most incredibly, Obama’s attorneys refused to assure the court, when questioned, that the NDAA’s section 1021 – the provision that permits reporters and others who have not committed crimes to be detained without trial – has not been applied by the US government anywhere in the world after Judge Forrest’s injunction.

I would also take the time to watch this short video from one of the co-counsels on the case as to exactly what the government is arguing in court.  Not a word from the mainstream media on the most important court case in American history.  One that will decide the fate of a law that will effectively dismantle at least a third of The Bill of Rights.

    • Both my wife and I are on medicare and social security, so we have a vested interest in keeping these programs solvent. After researching what Obama wants and comparing it to the Ryan plan I have to support the Ryan/Romney plan. If we continue with the Obama plan at some point in the future the system is going to colapse! And then we wont have aqnything! Both plans remove over $700 billion dollars from medicare, but they do different things with it! Obama is going to put it in Obama care to try to make it look less costly! Ryans plan would put the money in a type of reserve account that would be used for medicare in the case of a short fall in money collected for medicare, People under 55 would be put on a type of voucher system to help them purchase plans that serve their needs best. Most of us have little or no need for many of the things medicare covers but we have to pay for them anyway! This plan will be great for younger people, and it will put more security in the system that people like my wife and I, and your husband have to depend on. Believe me if Obamas’ plan was better I would support it! Neither plan is perfect but the Ryan/Romney plan is considerably less imperfect
      I was once a registered Dem., but changed to Libertarian after the Carter admin. My father retired on SS during the Carter admin. At that time there was no set day of the month that the SS check would arrive-sometimes there would be as long as 6 weeks between checks. Not only that the system was in danger of going broke. After Dad had been on SS for a few months instead of receiving a check he received a letter telling him that through no fault of his own he had been overpaid an amount equal to 1 and a half months. And the way they rectified THEIR mistake was by withholding that months check and only sending him one half his next check. Fortunately myself and other family members were able to make sure Dad got by. Under Carter as under Obama the price of gasoline doubled, prices of food, electricity, clothing, etc. skyrocketed. Annual inflation was running 20%, interest on loans was as high as 21%. Shortly after Regan was elected he reformed the SS program, prices stabilized and many of them went down. The inflation rate dropped to 3-4%, interest rates went to 6 %, and Dads check began to be delivered on the 3rd day of the month and continued to do so until he passed away in 2000. Not only that, he began receiving an annual cost of living adjustment that was equal to the inflation rate!
      I too once believed that Republicans were wanting to take away SS, but reality has trumped rhetoric. All the thing that have been done that adversly afected SS in my lifetime has been done by Dems, not Repubs. It was Dems that moved the SS fund into the general funds so they could spend it on even more wasteful programs. Carter nearly destroyed the program and if he had been re-elected it probably would have collapsed. It was Bill Clinton that made SS taxable if you made too much extra money. I went on SS disability in 2002, and received a cost of living adjustment every year under Bush. Under Obama I went 2 years without any adjustment because according to the Obama admin. there was NO inflation even though prices have increased rapidly every year under Obama. And the cola raise I got this year was an increase of $11 a month after the increased cost of medicare was taken out. If Obama is re-elected and the next 4 years is like the last 4 years with rapid price increase in energy costs, food costs, clothing cost, insurance costs, etc. I will no longer be able to pay my bills, buy food and clothing, and make my house payments. Under Bush we were able to save a little money, under Obama we have had to spend most of our savings.
      The economy is a shambles, Under the Obama/Clinton foreign policy the Middle East is a powder keg that could explode into war at any moment. Our money is being inflated at a rates that guarantee exploding prices. Obama alone can decide to have American citizens killed. Under this admin. Americans can be held indefinitely without trial or even specified charges. There is not room here to list the powers that has been usurped by President Obama and the rights and freedoms that this admin. is running roughshod over. Why any American of any race, gender, political or religious persuasion, would consider re-electing this man is beyond me.
      The policies of this admin. have done immense damage to the very people Obama claims to care the most about. Yet black and Hispanic Americans are going to vote for Obama in big majorities. Soaring rhetoric isnt going to pay the rent when there arent any jobs. Its time to stop making excuses for the failures of this administration and face the reality that 4 more years of this could destroy SS and medicare. I usually vote Libertarian even though I know my candidate will lose. This year I’m going to vote Republican, because for the first time in my life I truly fear for my country.
      Before you vote for Obama go back and review what he had to say about those “shovel ready” projects that he spent hundreds of billions on that he later admitted didn’t exist. So where did that money go?

    • Well I have hope that it won’t be this way forever. Nearly all revolutions in history have had moments that have transformed them from lost causes, to victories. The Russian Revolution for example was lost until the Cossacks refused to side with the Czar and sided with the people.

      Or take the Arab Spring that started in Tunisia, it took one street vendor lighting himself on fire for an entire country to get in the streets. There are always transforming moments that decide the fate of revolutions. We in the US aren’t at that point yet, it may take awhile, but then again it might not. With the power of the internet people are getting together now and realizing that we aren’t alone. The two party system is very entrenched and sure it might take a lot to shake people out of their programming. But it’s not hopeless.

  5. In all honesty, why is anyone worried about anything Obama signed into law? He is not eligible to sign anything and when he does it is null an void because he is not eligible. For all of those anti-Birthers out there I would like to say #1, Hillary Clinton, Clare McCaskill , John Conyers and others tried to change the constitution to legalize Obama before he ran for Prez. they couldn’t do it and hillary tried 3 times, he ran anyway and won, no one came forward and said anything, not that they knew he wasn’t eligible , nothing. They are all complicit, hew wasn’t legal then and he isn’t legal now.. He is not eligible according to his real Birth Certificate that sits in a British Archive, Hillary saw it in 2008 and said nothing. If nothing else, his Father was not born here so Obama wouldn’t be eligible anyway. Now how can he sign anything? How can he take 500 billion dollars from Medicare for his Obamacare, both of those acts are illegal if he is not the President , no one stopped him, no one said anything, he has been authorizing the UN to bring in the muslims by the thousands, maybe because his Father was a member of the muslim brotherhood for 30 years.     • As a conservative evangelical seminary graduate (Dallas Theological Seminary – MABS), I disagree with your assessment, and am embarrassed that you can’t even spell “Christian”. This nation was founded people from the Judeo-Christian culture, but it is NOT nor was it ever a “Christian nation” other than by sheer population statistics earlier.

      If half the money spent by “Christians” on political activism were spent instead on Jesus’ charge to us in Acts 1:8, maybe things would actually be better in this country for Christians. Having read the entire Bible multiple times, I have yet to find the verse that instructs us to act like obnoxious fools in the name of Christ…but judging by what I see around me, it MUST be there. We are to speak the truth, but IN LOVE (Eph. 4:15) – not hate.     • Mickey, though I would not have said it so harshly, I agree with you. We are brainwashed the moment we set foot in a public school, turn on the TV, eat practically any food with chemical additives and in dozens of other ways. The bottom line: UNTIL WE AS A PEOPLE LEARN HOW TO THINK, THERE WILL ALWAYS BE PIECE OF SHIT POLITICIANS TELLING US WHAT TO THINK. Most of us are children, living in adult forms but without the critical thinking skils of an adult. It is not hard to rule an empire of children…just give them toys. You want to see mass public action? Take away their fucking iPhones! Then you’ll see some serious righteous anger!!! But the systematic stealing of the very freedom that gave you the right and the opportunity to own that little piece of electronic shit? Nah, why bother.

      The only possible hope is a to educate massive numbers of people in the true principles of being human (sorry believers, I’m not talking about Christianity. Those principles, while true as true can be, have not saved us.). In addition to the actual principles, we’d also need to ensure that they be taught in such a way that it bypassed the unconscious resistance to learning things that conflicted with your current dysfunctional belief systems. Then we’d need a way to bring these newly educated people together so that they could support each other in creating conscious community.

      None of this, I’m afraid, will stop the crises that are headed our way but those of us that are prepared can at least ride it out together. After everything falls apart, either we or perhaps our children can begin to rebuild based on the principles that they learned.

      And yes, such an educational project is underway and it WILL impact tens of milions of people. This is for real. Stay tuned.

  13. Are You Scheduled for—Indefinite Detention?
    Journalists have not zeroed in on NDAA’s vague wording (Belligerent) U.S. Government can use to hold non-terrorists, anyone in Indefinite Detention.
    The Obama administration has not defined what they consider militant, or what is against the good of U.S. Government; or what constitutes a belligerent being directly aligned with militants to indefinitely detain Americans without charges. U.S. Government can claim any lawful communication with any person or group the government deems militant is directly aligned e.g. demonstrators. Even writers that exercise the 1st Amendment writing article(s) that disagree with or question U.S. Government or its allies could potentially be subject to indefinite detention on basis there writings were “against the good of America.”
    Current NDAA provisions would allow U.S. Government to arbitrarily round up large numbers of Americans, anyone U.S. Government deems a belligerent or threat to National Security. The Obama Government wants the power to incarcerate in indefinite detention any American it alleges a “Belligerent” without probable cause, charges, no right to an attorney or habeas corpus. Some observers believe NDAA included the vague term “Belligerent” so U.S. Government would have authority granted by Congress to—Indefinitely Detain Americans not involved in terrorism who participate in lawful 1st Amendment activities U.S. Government allege—appeared intended or used to support or provoke—hostilities, combatants, terrorism or belligerents; and or threaten National Security.

    NDAA 2012 opened the door for corrupt U.S. police; government agents and provocateurs which there are many, to file false reports and statements to target any American for arrest or disappearance. It is apparent some Members in Congress don’t represent the Constitution; otherwise they would not have voted down introduced amendments to the 2013 Defense Authorization Act of 2012 that would have protected Americans’ right to due process of law under NDAA. Sections of NDAA 2012 are so broadly written U.S. Government or the President may be able to (retroactively) deem any American or group’s prior 1st Amendment behavior as supporting hostilities, terrorism or (Belligerent) to order Indefinite Detention. Historical Note: the Nazi Government used similar laws to NDAA to arrest, indefinitely detain, disappear and execute without probable cause—their political opposition and confiscate the property of those arrested.

    It should be expected that indefinitely detained U.S. Citizens not involved in terrorism or hostile activities, not given Miranda Warnings when interrogated, not allowed legal counsel or habeas corpus may be prosecuted for non-terrorist (ordinary crimes) because of their (alleged admissions) while held in Indefinite Detention.

  14. The Act was, of course, to try to legitimize Guantanamo-style detentions in future. That said, we all know what happens when laws are passed for one reason and remain on the books long enough (does the word “metastasis” ring a bell?). We also know how someone like the (dis)Honorable Mr Chief Justice Roberts can take a law and torture it till it comes out constitutional. One wonders if at some point there was any plan to use it against Julian Assange (for whom I hold no brief) as well as against someone like PFC Manning; being procedural and not in any way creating a new “crime” or “tort,” presumably it gets around the constitutional ban against ex post facto laws, assuming such a nicety would still be observed by anyone looking to implement the statute, and could be used to classify those two as having engaged in the sort of activities that this law would allow such detentions for. Of course, the excuse will be that, upon conviction, the time already served will be credited to the sentence and the defendants’ rights will not have been violated under the Fifth or Eighth Amendments (Double Jeopardy, Cruel and Unusual Punishment) since they would spend the same amount of time behind bars anyway.

  15. and why did she consent to the jurisdiction of a maritime admiralty court if she has not committed any crime under common law? why not just assert her sovereign rights and send them and their unlawful inapplicable statues, which are NOT law. crimes require a victim and an individual perpetrator accused by affidavit in the courtroom and a JURY. the rest is just crap

  16. I am frankly not surprised at anything this administration does, given its desire for power.
    It all reminds me of Germany in the 30s………..
    God help us, literally, if he is re-elected for four more years.

    • The NDAA was not originated by this administration, you need to understand that. What is going on is an extension of powers and a reduction of liberties, something which has proceeded irrespective of whether Democrats or Republicans were in power. It used to be that the Supreme Court was our protector in this area, but these days it is a party to the oppression.

  17. This issue transcends party, race or religion. It is good to see that opposition to it is becoming more concrete. Irrespective of who wins the next election, they will do everything they can to expand it and gut our freedoms. This is the inevitable way of all governments given time and means. Unfortunately, I’m sure that like other important issues, this one will become partisan as well, but it should not.

    With the detainment of veteran Brandon Raub over facebook posts last week I believe your fear of the 1st Amendment targeting is spot on! Why didn’t Virginia’s NDAA nullification apply? Is the law too narrow??

  20. We say God bless America, but does America bless God? The resounding answer is No. We are idolitors serving the god of money, self, and pleasure. Examine yourself; what do you spend most of your time doing?

    Solomon and David were the wisest and one of the wisest people ever. This is what they had to say:

    Proverbs 16:2 All the ways of a man are clean in his own eyes; but the LORD weigheth the spirits.
    Proverbs 30:12 There is a generation that are pure in their own eyes, and yet is not washed from their filthiness.
    Proverbs 14:34 Righteousness exalteth a nation: but sin is a reproach to any people.
    Psalms 12:8 The wicked walk on every side, when the vilest men are exalted.

    Many people think that to be a Christian means to submit to blind faith. Faith yes, but not blind faith: Psalms 19:1 The heavens declare the glory of God; and the firmament sheweth his handywork.

    God is logical. The answer to America’s many fault resides with a remnant. I say remnant since many that name the name of Christ, that is call themselves Christians, are deceived. Man defines Christians with a broad stroke, but the Bible is more precise. Matthew 7:20-23 Wherefore by their fruits ye shall know them. (21) Not every one that saith unto me, Lord, Lord, shall enter into the kingdom of heaven; but he that doeth the will of my Father which is in heaven. (22) Many will say to me in that day, Lord, Lord, have we not prophesied in thy name? and in thy name have cast out devils? and in thy name done many wonderful works? (23) And then will I profess unto them, I never knew you: depart from me, ye that work iniquity.

    The logic I’m referring to was directed to the Jews, but is still applicable to Christian today:

    2 Chronicles 7:14 If my people, which are called by my name, shall humble themselves, and pray, and seek my face, and turn from their wicked ways; then will I hear from heaven, and will forgive their sin, and will heal their land.

    A classic if then solution to our problems. Will there be another Great Awakening in America? This is my burden and is shared my many Christians in my circles.

    I’d apologize for my modest preaching, but this and so much more is what America needs. I am a fundamental, Bible believing, Baptist layman that yearns to see God move. He is waiting for the few to die to self and fullfil the requirements for him to do so. May I and beloved brethren be stedfast, unmoveable, always abounding in the work of the Lord, forasmuch as ye know that your labour is not in vain in the Lord.

    Psalms 118:8-9 It is better to trust in the LORD than to put confidence in man. (9) It is better to trust in the LORD than to put confidence in princes.
