Caught on Tape – TSA Gropes 10 Year Old Girl for Two Minutes Due to Capri Sun in Baggage

Just when you thought the TSA couldn’t possibly get any worse…

From the San Diego Tribune:

A Capri Sun juice pouch mistakenly left in a 10-year-old San Diego girl’s carry-on handbag led a TSA agent to subject the girl to almost two minutes of frisking and extra screening that lasted about an hour, her father said.

Liquids exceeding 3 ounces are not allowed in carry-on bags, for fear they might contain explosives, but the girl’s father said the resulting search was an over-reaction and an inappropriate intrusion.

Kevin Payne of Pacific Beach and his daughter, Vendela, were passing through the Raleigh-Durham International Airport on Dec. 30, 2015, headed home to San Diego, when U.S. Transportation Security Administration agents discovered the liquid.

Authorities followed up with a swab of the bag and a false-positive test for explosives, then a nearly 2-minute-long full-body pat-down in which a female TSA agent touched the girl’s buttocks and groin repeatedly.

Payne said TSA agents told him he wasn’t allowed to film, but he asserted his rights and was able to capture the incident on video, which he has since posted on YouTube and Nextdoor.

“If you look at videos, most pat-downs on adults (take) about a minute,” Payne said. “Start to finish, in real time, (Vendala’s pat-down) was 1 minute and 47 seconds. It just didn’t seem like it was an efficient pat-down.”

Payne said TSA agents made it clear to him that he would be arrested if he tried to interfere with their search of his daughter. So he kept calm, waved to his daughter, and made funny faces at her to keep things light.

I’m sorry, but the only terrorism I see happening at this airport is courtesy of the TSA. A completely lawless agency, which recently illegally changed it’s rules to say that body scanners may be mandatory for “some” passengers, without making it clear what the criteria for this arbitrary exclusion is.

Importantly, it appears the TSA’s latest shady move may be illegal. As Forbes reported in the article, TSA Body Scan? Just Say ‘No,’ Leading Expert Says:

Passengers required by the Transportation Security Administration (TSA) to submit to a body scan can legally refuse, according to Marc Rotenberg, President of the Electronic Privacy Information Center (EPIC).

Specifically, Rotenberg stated in writing that “ passengers have a legal right to refuse the AIT scan. The agency action is contrary to the earlier representations before the D.C. Circuit and to the holding in EPIC v DHS.”

He elaborated that “the last minute announcement by the TSA is troubling and appears contrary to the agency’s previous representations about the program and to the decision of the D.C. Circuit in EPIC v. DHS. In that case the DHS represented that the body scanner program was optional and that passenger could always elect to opt for a pat-down. The D.C. Circuit, relying on the government’s representation, concluded that there was therefore no Fourth Amendment violation, because as Judge (Douglas H.) Ginsburg explained for the court,

‘More telling, any passenger may opt-out of AIT screening in favor of a pat-down , which allows him to decide which of the two options for detecting a concealed, nonmetallic weapon or explosive is least invasive.’”

  1. As long as the American serfs continue to submit, the masters will continue to abuse them.

    Economic retaliation is all that is left. Refuse to travel through American airports. If airline revenues dropped 50% it might get someone’s attention.

    But it ain’t gonna happen. The serfs are still too comfortable.

  2. Ken is absolutely correct in that we need to combat this nonsense with noncompliance. Just don’t fly, period. I haven’t flown for many years as I refuse to submit to this nonsense. Unfortunately, most people do not care if their rights are violated as long as they have convenience of flying.

  3. Your a sorry excuse for a father. Exploiting your daughter like that. The TSA lady was doing her job. If a plane was to blow up you would be at the front of the line complaining about the TSA. These are the times we live in. Group up and stop using your daughter for your 15 minutes of wannabe fame.

      How many thigh rubdowns are required to locate explosives on a ten year old? How many 10 year old girls have blown up planes? (hint… it is the number that comes before 1) The article stated that the bag was wiped for explosive residue and came back clean.

      There was no reason to scare this little girl.

      I am fully aware of the crimes against humanity our Government has perpetrated and continues to perpetrate. But when an agency like the IRS demands money from me..I pay them..why?
      Because I am just one person, and if I refuse to comply, eventually they will send men with automatic weapons to extract me…and if I resist they will kill me. then what? nothing changes…until we organize and become an orchestrated force to be reckoned with, they will continue to oppress us.
      don’t judge your fellow man too harshly in these difficult and trying times…Most people hate this new format of fascism, but are scared and feel alone and powerless.

    Anybody who thinks the TSA is doing anything to prevent an attack needs his head examined (but hey, that’s only about half the population of the U.S.). While they’re confiscating breast milk, peanut butter, perfume, and cupcakes, strip-searching Granny, and sticking their hands down your pants, they’re letting loaded weapons on planes. This isn’t the first time, and it sure as hell won’t be the last.

  6. Unfortunate consequences of 9-11. I believe the TSA agent was doing her job. I am quite sure that the agent did not abuse the 10 year old who in my opinion, held up quite well under this ordeal. In no way was she groping this child. I honestly feel for the father to see his young daughter who is innocent undergoing this ordeal. I am neutral on the fathers decision to place this on the internet. Unfortunately we live in times which are dangerous. When I fly I comply to all because I want to get to my destination in one piece.I guarantee everyone that most TSA agents by far and by far are great people who are doing their job which I feel is necessary. They must keep the pressure on to maintain the airports as hard targets ( to discourage would be terrorists). They are insuring that no planes go down.

  7. I allowed myself to be molested by the TSA once, and I will never fly again. It was the most intrusive and disgusting experience I’ve ever been through – and I’m 46 (and not the most innocent woman in the world). Just looking at that little girl being put through that makes me want to throw up. I couldn’t even watch the video. When I was patted down that woman had her hand in my crotch 5 times. I never felt so violated in my life.

    Oh, and Fred & David… you’re both idiots. That TSA agent was not “just doing her job”. If she was doing her job she’d be spending her time looking for people who actually pose a safety risk, rather than using resources to feel up a 10 year old red headed little girl.

  8. I can understand your feelings. They are partly do to honest and sincere human emotion which I can relate to it. And this can be a good thing. However, the determined terrorist will use these emotions to use what looks like a defenseless and harmless little girl ( whether she knows it or not) to introduce a bomb unto an airplane. Unfortunately these tactics are a fact of life. Playing upon human emotions to cause the most damage. It happens all the time. Its rather stealthy and evil. Its unfortunate.

    • I don’t say this in anger, but I do want to be clear. This has nothing to do with my feelings. Yes, seeing that little girl be subjected to having her genitalia groped does evoke a very visceral feeling in me, but my feelings are not the true issue here. The TSA’s tactics in ensuring the safety of airline passengers is not only ineffective, it is personally invasive. Your statements sound reasonable, but there is a clear message behind what you say – “Take away our rights, as long as you make us safe!” You say that terrorists play upon human emotions to cause the most damage. Can you not see that our government does the same thing to cause the most damage to our liberty? What is “stealthy and evil” is our own government’s active and purposeful actions to confiscate power, authority and dominion over what are supposed to be free citizens. It is our government that is playing on people’s emotions. They are using every opportunity to play upon people’s fears and get them to acquiesce their freedom. We are under assault… by our own government. And the ultimate example of that is when a father is forced to sit helplessly by and watch his 10 year old dtr be molested by a TSA agent. But it’s okay. After all, it was a woman doing the groping. And she was only doing her job.

  9. You get the TSA and intrusions you deserve. If you all stop flying you’ll hit the airlines where it hurts most–their profits and they protest to the government and kick up such a fuss that it will stop. 99..9999 % of the population are NOT terrorists and never will be.
    You must realise that this crap is just to see how complacent passengers will be; if you all refuse to allow this intrusion into your personal freedom to travel in your own country then it will stop. People power is extremely effective but you must protest publicly not whinge into your beers in the bar.
    You are not a terrorist—-so don’t let these clowns treat you as if you are. If you all can’t see the lunacy of what this pervert did to that young child, you’re already past redemption I’m afraid…..
