Florida Man Sentenced to 2.5 Years in Jail for Having Sex on the Beach

Back in May, I highlighted the case of 40-year-old Jose Caballero, who faced 15 years in jail for having sex on a Florida beach in broad daylight. Here’s an excerpt from the post, titled: Florida Man Faces 15 Years in Jail for Having Sex on the Beach (Still No Bankers in Jail):

This story demonstrates how completely and totally broken the U.S. justice system is. Should this couple have been having sex in public and in broad daylight? Absolutely not. Should there be some sort of punishment? Absolutely.

That said, the punishment should fit the crime in a just civilization, and 15 years behind bars for public sex is more akin to what you’d expect in Saudi Arabia. It’s particularly appalling when compared with the license to commit fraud and steal, which politically connected oligarchs have been granted. After all, who was really harmed by this couple’s act? Sure, some tourists may have had their day temporarily ruined or inconvenienced. A three-year-old girl may have seen something, but would probably have no way of understanding what it was. On the other hand, criminal bankers have demonstrably ruined the lives of hundreds or millions, if not billions, of people across the globe. Yet not a single TBTF executive has been prosecuted. They were bailed out instead.

Meanwhile, what about the pastor who faces only four months for molesting a little girl. Yes, you read that right. Our society is so completely fucked up, that two people irresponsibly making love in public will have their lives ruined, while a religious authority caught molesting a little girl receives a slap on the wrist.

Land of the Unfree – Police and Prosecutors Fight Aggressively to Retain Barbaric Right of “Civil Asset Forfeiture”

Efforts to limit seizures of money, homes and other property from people who may never be convicted of a crime are stalling out amid a wave of pressure from prosecutors and police.

Their effort, at least at the state level, appears to be working. At least a dozen states considered bills restricting or even abolishing forfeiture that isn’t accompanied by a conviction or gives law enforcement less control over forfeited proceeds. But most measures failed to pass.

The fact that civil asset forfeiture continues to exist across the American landscape despite outrage and considerable media attention, is as good an example as any as to how far fallen and uncivilized our so-called “society” has become. It also proves the point demonstrated in a Princeton University study that the U.S. is not a democracy, and the desires of the people have no impact on how the country is governed.

Civil asset forfeiture was first highlighted on these pages in the 2013 post, Why You Should Never, Ever Drive Through Tenaha, Texas, in which I explained:

In a nutshell, civil forfeiture is the practice of confiscating items from people, ranging from cash, cars, even homes based on no criminal conviction or charges, merely suspicion. This practice first became widespread for use against pirates, as a way to take possession of contraband goods despite the fact that the ships’ owners in many cases were located thousands of miles away and couldn’t easily be prosecuted. As is often the case, what starts out reasonable becomes a gigantic organized crime ring of criminality, particularly in a society where the rule of law no longer exists for the “elite,” yet anything goes when it comes to pillaging the average citizen.

David Petraeus – How This Leaker of Classified Information is Peddling KKR Funds as Opposed to Serving Jail Time

David Petraeus, as much as anyone else in America, personifies the completely corrupt, unjust, and fraudulent application of the rule of law in these United States today.

I continue to think that the unequal application of justice in America is the single most important issue that must be faced. So many of our problems would be solved overnight if the masses weren’t locked up for Orwellian “victimless crimes,” and rich and powerful criminals were thrown in jail up for extended periods for their far more societally destructive actions.

The case of David Petraeus has been discussed here before, most recently in the post, Some Leaks Are More Equal Than Others – Hypocritical D.C. Insiders Line up to Defend General Petraeus from Prosecution. Here are a few excerpts:

The decimation of the rule of law in these United States has been the key theme at Liberty Blitzkrieg for several years now. The reason I put such an emphasis on this horrible development, is because I think it trumps all others in significance. While the world will always have crime and corruption, the inability for a society to deal with rich and powerful people who engage in such practices thrusts a spear directly into the heart of any given civilization or society. It results in an exponential increase in elite criminality, and a concurrent death spiral downward into a culture primarily defined by a depraved, unaccountable oligarchy. These are symptoms of a fallen society, and these symptoms are evident all around us.

Florida Man Faces 15 Years in Jail for Having Sex on the Beach (Still No Bankers in Jail)

A jury Monday found a couple guilty of having sex on Bradenton Beach after only 15 minutes of deliberation.

The convictions carry a maximum prison sentence of 15 years.

Both Caballero and Alvarez will now have to register as sex offenders.

Ronald Kurpiers, defense attorney for the couple, said his clients were “devastated,” by the verdict. Though Dafonseca hinted that they’d be speaking with the judge about whether or not 15 years was appropriate for Caballero, Kurpiers said the judge would have no discretion.

“That’s what he’ll get,” Kurpiers said.

This is what “justice” looks like in the Oligarch States of America. If you’re a pleb who gets caught having consensual sex on the beach, you’re immediately convicted and face up to 15 years in the gulag. Meanwhile, if you’re a banking executive responsible for crashing the global economy, you’re rewarded with trillions in taxpayer bailouts and backstops and given free reign to continue your crime spree. Criminal charges are never considered, despite the extreme negative impact your actions have on society at large, and you’re always given a slap on the wrist via deferred prosecution agreements, or DPAs. American Justice – FBI Lab Overstated Forensic Hair Matches in 95% of Cases, Including 32 Death Sentences

The Justice Department and FBI have formally acknowledged that nearly every examiner in an elite FBI forensic unit gave flawed testimony in almost all trials in which they offered evidence against criminal defendants over more than a two-decade period before 2000.

Of 28 examiners with the FBI Laboratory’s microscopic hair comparison unit, 26 overstated forensic matches in ways that favored prosecutors in more than 95 percent of the 268 trials reviewed so far, according to the National Association of Criminal Defense Lawyers (NACDL) and the Innocence Project, which are assisting the government with the country’s largest post-conviction review of questioned forensic evidence.

The cases include those of 32 defendants sentenced to death. Of those, 14 have been executed or died in prison.

“These findings are appalling and chilling in their indictment of our criminal justice system, not only for potentially innocent defendants who have been wrongly imprisoned and even executed, but for prosecutors who have relied on fabricated and false evidence despite their intentions to faithfully enforce the law,” Blumenthal said.

The American justice system is broken. Completely and totally broken. This has been one of the key themes here at Liberty Blitzkrieg since inception, and I’ve come to realize that the death of the rule of law is the single most important issue facing our society at this time.

This site has focused on the increased use of selective prosecution in these United States. If you are poor, disenfranchised, or a dissident, the full force of the law will rain down on your skull like a thousand tons of bricks. We have seen this repeatedly in cases such as the South Carolina man who was fined $525 and fired from his job when he failed to pay for a $0.89 soda refill. We saw it in the case of Aaron Swartz, the child prodigy was driven to suicide by overly aggressive and ambitious feds. Finally, we saw it in the case of Barrett Brown, who was threatened with over a century in jail for essentially exposing the criminality of certain very rich and/or powerful individuals.

On the other side of the fence, we see that anyone associated with the power structure can do whatever they want with zero repercussions. We saw this in the case of General David Petraeus, who received a slap on the wrist for passing on highly classified information to his mistress and biographer Paula Broadwell. We saw it in how DEA agents were’t even fired from their jobs despite participating in sex parties filled with prostitutes that were paid for by drug cartels, and sometimes taxpayer funds. Most despicably, we have seen it in the explosive use of deferred prosecution agreements when it comes to all the bailed out Wall Street banks, thus ensuring that no senior bankers went to prison and that their bonuses would be forever protected.
