Why the Standoff at the Bundy Ranch is a Very Big Deal

If you haven’t been following the unfolding drama at the Bundy Ranch about 80 miles northeast of Las Vegas you need to start now. The escalating confrontation between irate local residents and federal agents of the Bureau of Land Management (BLM) has the potential to take a very dangerous turn for the worse at any moment, as hundreds of militia members from states across the country are expected to descend upon the area and make a stand with 67-year-old Nevada rancher Cliven Bundy.

Before I get into any sort of analysis about what this means within the bigger picture of American politics and society, we need a little background on the situation. The saga itself has been ongoing for two decades and the issue at hand is whether or not Mr. Bundy can graze his 900 head of cattle on a particular section of public lands in Clark County. Cliven Bundy has been ordered to stop on environmental grounds to protect the desert tortoise, but he has stood his ground time and time again. As a result, the feds have now entered the area and are impounding his cattle. According to CNN, Between Saturday and Wednesday, contracted wranglers impounded a total of 352 cattle. The Bundy family, as well as a variety of local residents have already had confrontations with the BLM agents. Tasers have been used and some minor injuries reported. Most significantly, militia members from across the country have already descended upon the area and it seems possible that hundreds may ultimately make it down there.

To me, the argument of who is right and who is wrong in this situation is the least interesting part of the story. I have noted time and time again that the feds are becoming increasingly out of control and belligerent to American citizens. We know the stories (think Aaron Swartz) and we know the overall trend. However, the reason the Bundy Ranch confrontation is so interesting, is that for whatever reason this particular incident seems to be striking a chord of dissent. It is often times the most random, unforeseen and innocuous things that spark social/political movements. This standoff has it all.

LAS VEGAS (CBS Las Vegas/AP) — Militia groups are rallying behind a rancher whose cattle are being seized by the federal government.

The Las Vegas Review-Journal reports that two militia members from Montana and one from Utah have arrived at Cliven Bundy’s ranch.

“We need to be the barrier between the oppressed and the tyrants,” Ryan Payne of the West Mountain Rangers told the Review-Journal. “Expect to see a band of soldiers.”

Payne said that militias from New Hampshire, Texas and Florida are likely to join and stand with Bundy and stay at his ranch.

“They all tell me they are in the process of mobilizing as we speak,” Payne told the Review-Journal, adding that hundreds of militia members are expected.

Lawmakers are adding their voices into the fray, criticizing the federal cattle roundup fought by Cliven Bundy who claims longstanding grazing rights on remote public rangeland about 80 miles northeast of Las Vegas.

Sen. Dean Heller of Nevada said he told new U.S. Bureau of Land Management chief Neil Kornze in Washington, D.C., that law-abiding Nevadans shouldn’t be penalized by an “overreaching” agency.

Republican Gov. Brian Sandoval pointed earlier to what he called “an atmosphere of intimidation,” resulting from the roundup and said he believed constitutional rights were being trampled.

The fact that a U.S. Senator and the Governor are publicly coming out against the feds is in my opinion a very big deal and may signal the beginning of a true fracturing in the social fabric. Something that I have been expecting for many years.

Heller said he heard from local officials, residents and the Nevada Cattlemen’s Association and remained “extremely concerned about the size of this closure and disruptions with access to roads, water and electrical infrastructure.”

The federal government has shut down a scenic but windswept area about half the size of the state of Delaware to round up about 900 cattle it says are trespassing.

Sandoval said he was most offended that armed federal officials have tried to corral people protesting the roundup into a fenced-in “First Amendment area” south of the resort city of Mesquite.

The site “tramples upon Nevadans’ fundamental rights under the U.S. Constitution” and should be dismantled, Sandoval said.

People being rounded up like cattle in these bullshit “First Amendment areas” is completely unacceptable.

BLM spokeswoman Kirsten Cannon and Park Service spokeswoman Christie Vanover have told reporters during daily conference calls that free-speech areas were established so agents could ensure the safety of contractors, protesters, the rancher and his supporters.

Meanwhile, federal officials say 277 cows have been collected. Cannon said state veterinarian and brand identification officials will determine what becomes of the impounded cattle.

The kindling for social upheaval has been growing in America for quite some time. Disrespectful and ignorant statements from billionaire oligarchs like Sam Zell only make it worse. The question in my mind has always been what will the catalyst be to spark the brushfire? Will it be the Bundy Ranch? We’ll have to wait and see.

Personally, I hope cooler heads prevail and there is no violence, because once you head down the road of violent confrontation between the people and the feds you are opening up a can of worms that will not easily be bottled up again. In such a situation, everybody loses. However, my long-term fear is that unless the government and its puppet masters on Wall Street and elsewhere in big business change course, social upheaval will prove inevitable, whether the Bundy Ranch sparks it, or some other incident down the road. These are troubled times and they are likely going to get worse before they get better.

  1. Where is your land in Co.? I want to run my cattle over it and then not leave when you ask me to for years. Bunny doesn’t own that land. He is clearly trespassing. If on private land the ordeal would have been over many years ago in an hour. No one likes others cattle on their land. Period. Sure the BLM is a pain. But it is their land to manage. For a guy all up about property rights, you are on the wrong side here. He is trespassing. Simple. I would have shot them if they came on my land and he would not remove them promptly after repeated requests. You would have as well.

    • Well since “we the people” are the government and the government owns this land I have a right to an opinion on what the federal government does with the land.       But beyond that, I emphasized the fact that who is right and wrong is not the most interesting part of the story. What I focus on is clearly the backdrop of kindling for social upheaval that exists and the potential that Bundy Ranch is a catalyst. So I find it bizarre that you chose to take issue with the one aspect of the story I deliberately chose to deemphasize.

    • Absolutely right about the implications. As riveting as the details of this single incident is, the really significant story is how this is part of an accumulating narrative of individual or state/local resistance to federal authority.

      Take a look at the marijuana laws; there is outright rebellion with state laws in conflict with federal. Same with gun control, gold coinage, environmental and so on. We don’t even have to go into the whole 10th Amendment movement.

      What it all adds up to is incontrovertible evidence we are on a collision course between federal and all other authority. So far, the feds have backed down publicly but attempted to achieve their goals quietly later.

      When it REALLY will heat up is when, no matter how the feds attempt to cool things off or appear to be compromising, it is seen as all lies and obfuscation…which it is.

      If I had to bet today, I would bet that there will be many cases of armed resistance, perhaps to the point of open revolt.

      I also predict the feds will lose despite their superior arms. Why? They are on the wrong side of history. We are moving to true democratization and away from centrally run organizations. They will fight like hell to retain the power but they have picked the losing side. It’s just a question of how many people they kill–and kill them–before they figure it out.

You are also right the fed should not be seazing cattle on public land, especially without trial, since your article never states if there was a trial or not im assuming there wasnt. How ever the fact this has been going on for several years now should be reason enough to be on the blms side. They are enforceing a law that was voted in by most of are democraticly elected officials. Im pretty sure that makes us the tyrants doesnt it?     • Actually, the government isn’t supposed to own land such as this. The only constitutional federal land is DC, federal buildings, and military reservation. This land was purchased from Mexico (Treaty of Guadalupe Hidalgo) and was never conveyed to Nevada upon statehood but it should have been. Arizona, Utah, California, New Mexico, etc..also have large parcels that have not been conveyed. The National Forest, BLM, and national parks were created as riders on appropriation bills. The states can and should sue to get the land conveyed to the state.

  2. The question is, as I just scanned this article, who OWNS the land. Does Mr. Bundy? Or, is it a lease from the Bureau of Land Management? If it is BLM land, Bundy has no right to breech the protection the BLM offers any creature, because the BLM can cancel a lease at any time, sell the land, or do anything it wants. There is much more involved and too few FACTS available for the public to offer any opinion. And, the article says it is “public land”=BLM property……basically owned by ALL of us….and let me recover rolling on the floor and laughing at the Government considering anyone in the US having any rights to anything.
    We owned a 187 section ranch in New Mexico, bordering the Acoma and Laguna Reservations. The lease would have gone on forever, as we controlled the property with the lease…..and ownership of ALL of the waters. But, in prior years, the BLM had canceled the lease on thousands of acres “on the mesa” above Blue Water Canyon, and awarded it to the Acoma Indians.
    Our ranch was “checker boarded” with BLM, New Mexico-Arizona Land Company, and railroad land….along with our private land. As long as BLM land is included in any property, they virtually control it….as bad as that seems. BUT…..90% or our land was leased.
    I feel for Mr. Bundy, but instead of people getting killed over this, the truth and the facts should be presented. I now live in Waco, and you all should be aware that anyone around here would NEVER like to see anything like the Compound occur again.

    • Its not as simple as who owns it. Were the mineral and gas rights sold off unknowingly to anyone? Is that deal legitimate? It was grazing land since when? The grazing and land ownership are the least of the worry here. Taking a man’s cattle, suspending the first amendment, and mistreating citizens with authoritarian ‘officers’ is the greater concern.

    • From articles I’ve read. Bundys family was there and using the land before the BLM was established. I believe they are also making this point to draw attention to the Ried’s involvement and lies to grab this land!

      If the court’s decision was based on false and fabricated information, now mercenaries are being hired and put in BLM uniforms to enforce a court order, There’s something seriously wrong in Nevada!

      This needs the nations attention!!!

    • “Cancelling” a lease is properly called ‘default’ and gets you sued, or you end up having to fulfilling your side of the bargain without getting the benefit from the other party.

  3. Very interesting story and it’s not about the legal nitpicking.

    It’s the only ranch in Clark County and the cattle has been grazing on public land since the 1870’s. Why shouldn’t they continue? What other use is there for this harsh landscape?

Can’t do this while his cattle are standing on it. There are also rumors of frackable shale oil underneath. Kornze, the new head of the BLM – what a surprise! – is also a Nevadan and tied in with Reid.

      Technically, under the Constitution, the land is a State issue ONLY, and that is precisely what My Bundy is fighting for. That is why he’s put himself out on a limb like this… The land belongs to the people of Nevada, (Mr Bundy and all of those others who live there – and they’re taking a stand). That land does NOT belong to the Federal Government. The Feds have absolutely no rights to the land whatsoever. It’s 100% a State issue only under the Constitution. Keep in mind that the USA is still a Republic last I checked. What outsiders don’t know is that the Feds have come in slowly, over the years and now have literally seized 90% of the land in Nevada. Why??? Nobody knows, and we are not being told anything. Mr. Bundy understands the United States Constitution, and he (and the others in the State of Nevada) see what the Feds are doing. So do thousands of other neighboring State citizens. And, that is why they are coming to lend support. This is a very important issue, and what happens here will be historical as this grows and as the Militia forces begin to set-up base.

  5. There’s a very important fact left out of this article. The other 53 ranches were chased out by BLM. He’s the last guy standing. Oh did I mention that Harry Reid already promised the land to the Chinese for a solar farm, and has been trying to force the family out for years also for their water rights and minerals in their area. BLM has a horrible record for protecting wildlife. They’ve killed way more animals than saved. Before jumping to conclusions guys, pleaaaase learn all of the facts. The issue here is huge. The government has gotten way out of control and now feels it’s their right to take what ever they want.

  6. There are several issues arising here. This is just the situation that is culminating a lot of frustration.

    The first would be is the land owned by the State Government or Federal Government? If it belongs to the Federal Government, why do Sheriffs had the authority to override federal jurisdiction? That is an issue for states to pursue.

    The second issue is, if, the Bundy family “bought the rights” to graze on the land, then it is not leased. Those rights were sold outright. The BLM cannot charge fees for use, if those rights were sold. Even though, the BLM can cancel leases, there is no lease to cancel. Obviously, the Federal Government feels it needs some social justification since they claimed this is to preserve an endangered tortoise species, which, we know for a fact is a lie, 700 of those tortoises were killed at The Las Vegas wildlife Sanctuary to save on expenses.

    So the third issue is, if the Federal Government is protecting an endangered species, then it cannot sell or develop that land or doing so would, in itself, endanger the tortoises. It would have to be an environmentally protected area free from development.

    Fourth issue is, the Federal Governments intended use for the land. The government has brought in heavy digging equipment such as backhoes, which would not preserve the land and it is for some kind of development. If, the Federal Government intends to sell that land to foreign investors and companies for development. is that in the best interest of the people or other countries?

    Personally, I don’t think any Federally seized land should be sold or developed by foreign companies, when American companies could do the same. Case in point, (correct me if laws have changed since I last looked) foreign companies free of charge, strip mine Federally owned land leaving it devastated and are allowed to take gold out of this country tax free. I personally do not condone strip mining by anyone.

    The fifth issue is, there is no constitutional authorization for the Federal Government to claim ownership or control over State resources such as: minerals, water, fuel, electricity and transportation. The United States Constitution does forbid the Federal Government from restricting the first, second and third amendment rights and other un-numerated rights of the State and the people, under any circumstances.

    The sixth issue is that have had their fill of our corrupt Federal Government violating our United States Constitution and both houses of Congress allowing it. The unconstitutional presidential candidate sitting in the White House has openly declared internationally that our constitution is dead and that The United States will be a Muslim country by 2016. The use of executive orders to write or violate laws is specifically stated by our founding fathers as being without force, unenforceable.

    The seventh issue is how do we stop the lawless want-to-be dictator and a runaway power grabbing Federal Government?The Federalist Papers, The Declaration of Independence and quotes from our founding fathers express exactly what this government is and how it is restricted. The United States Supreme Court has turned it’s back on the law, The United States Constitution, the principles and the God under which this nation was conceived. How can Christians and Christian owned businesses be forced comply with Obamacare (ATA) when Muslims and Muslim owned businesses are not simply based on their religion? The law must be the law and apply to everyone equally.

  7. Ranchers are well known for posting Private Property No Trespassing signs on public land and then chasing citizens who have every right to be there off AT GUNPOINT. These folks have developed a feudal mentality with regard to land doesn’t belong to them and the time has come to disabuse them of these notions. WE THE PEOPLE NEED TO ABOLISH THE PRACTICE OF GRAZING ON PUBLIC LANDS. The real irony here is that Bundys family likely didn’t come into possession of the land they claim they own privately lawfully, or honestly. We demand to see full records and documents from between right before the land changed from the Mexicans in 1848 and 1950. It is documented that huge tracts of land were stolen and courthouses, town halls and records burned to cover up the widespread criminal activity by ranching families. This is how many of the large “spreads” currently in the hands of 4th generation ranchers came into existence. THIS AINT BONANZA

  8. For those who are unfamiliar with U.S. history when unrolling barbed wire was invented around 1874 the largest land theft in American history took place. Ranchers bought as much as they could afford and just went out and unrolled fence over as much public property as they had wire. An orgy of courthouse burning and records destruction ensued. Many of the large spread in the control of 3rd and 4th generation ranchers came into existence in this fashion. Ranching is an ancient profession and can add harmony and balance to human life or it can become distorted and warped by greed. Ranchers all along the Southern border participated in the land thefts as did many in Nevada. In consideration of this issue We The People demand to see original deeds and titles to all the lands laid claim by the ranchers. We The People demand to see actual original records from 1840 immediately prior to the change of hands from Mexico to America and through 1950 immediately after World War II. The ranchers are well known to post private property no trespassing signs on public property belonging to the American people and to chase people away AT GUNPOINT from land that does not belong to them. These folks need to be disabused of the feudal mentality they have developed with regard to public land and we need to abolish the practice of grazing on public lands.

    • I have in my possession a copy of the Treaty of Guadalupe Hildago, and the Statehood documentation creating the State of Nevada from the Possession of the land covered by the treaty.

      There is nothing in either that would give the federal government the powers or authority that they have claimed.

      The Constitution of the United States clearly does not allow the federal government to seize land from the States. It must be purchased or ceded by the state to the Federal Government. The lsit of uses to which this land may be put is limited and it does not include sale or lease. It must be used for Armories, Magazines, dock-Yards, Forts, and other needful buildings.

  11. The only issue here is jurisdiction. Looking at the enabling act of 1861 and the 1864 Nevada Constitution, that Constitution was declared by Congress to be a republican form of Government, and was admitted on equal footing. I believe the Federal government has no authority granted to lay claim to 84% of Nevada state, and is violating the equal footing doctrine, and is acting outside it’s authority. Therefore, I believe any Federal agents who cause harm to the people at Nevada state, are doing so without authority and may be liable in their individual capacity. I would suggest anybody coming in contact with these agents, get their id and badge number.

    Also, if you look further into this matter, it has nothing to do with endangered tortoise.

    Mr Bundy is not above the law. He is in contempt of court orders and has not paid required fees for 20 years, the same fees 18,000 others pay yearly.
    He is using emotional misleading sometimes irrelevant statements to whip up support and is causing over 3,000,000
    of our tax dollars spent because he doesn’t agree with government regulations. He should be jailed and his 167 acre ranch seized to pay for 1,000,000 in unpaid fees/fines. Someone could get killed over this brouha.
    BTW I am strongly conservative-not a liberal. I just see through his smoke and mirrors.

  13. If you think the gov. cares one bit about the desert tortoise or any living creature including a human being then you are completely misguided. Do you think the gov. would send in snipers and create a huge public fiasco because of a tortoise? No, they would not.

    At the end of the day this is about the same one song and one dance that gov. knows how to do. They lie. They cheat. They steal.

    Sen. Harry Reid, like all crooked politicians, has a hidden agenda that will eventually come out. It’s not about protecting anything, or anyone, other than themselves.

Each state was established sovereign and all land within the boundaries of Nevada belong to the people. Its called inalienable rights. The right to use the land just as any other animal or insect freely travels about without restrictions. Over time, the United States INCORPORATED and enacted laws, bills, legislation, fines, etc and claimed we are required to “rent” our land from them. We also let them convince the following generations that we are a Democratic society- another lie. I bet not one of you has studied the constitution, bill of rights, or federalist papers and yet you allow opinion of what you think to rule your choices. Did you know Obama signed an EO that now allows him to kick out every human from their home because you can’t own anything? Not even your car- the Feds took away ALLOIDIAL title which means that registering your car is merely rent. Ignorance is not BLISS but dangerous. Bundy’s land is in Nevada’s. Nevada Constitution says if you use the land you have a simple responsibility- maintain it. He improved the land by running over a 100 miles of water irrigation, kept it clean and paid Nevada! He was fighting to keep the land PUBLIC. There used to be 52 ranchers using the land but they folded. People of Nevada hunt, fish, and use the land for recreational vehicles and camping- the feds wanted to privatize it Federally and charge fees like a park and make designated areas. 20 yrs ago the blm offered to buy him out and he refused so he is blocking the feds planned for profit – for them- by selling weapons grade mineral rights to the military, leased it to the Chinese, and also an energy company out of Texas for a natural gas fracking operation. PLEASE STUDY CONSTITUTIONAL LAW. Please study Agenda21- they are stealing our land. I have studied this for 10 years. We are in serious trouble when Land Management has snipers, apache helicopters, black ops against AMERICAN CITIZENS who were unarmed.

    • It will require a long and costly court fight, but fortunately these Executive Orders are not law.

      That is clearly expressed in Article 1, Section 1, of the Constitution which states: “All legislative Powers herein granted shall be vested in a Congress of the United States, which shall consist of a Senate and a House of Representatives.”

    It’s imperative that we understand what the manufacture of consent is. In other words we must be aware that those who control the education system control the methods of communication and they tell us what they want us to know and don’t tell us what they don’t want us to know thus it is a closed and not complete perspective most of us are exposed to because they have us trapped sometimes working three jobs, struggling to survive, too busy to work out and eat well, we do not have the time or energy to read alternative sources.   18. I have a question about all of this. Bundy, a rancher, was grazing his herd on ‘fed’ lands. He was doing this for his business. What is now going to keep other businesses from going in and setting up their enterprises? This is a double-edged sword, IMO. When there is any chance of money being made, responsibility often flies out the door. Anybody have any input on this?
